These Terms of Service (“Terms,” “Agreement”) constitute a legally binding contract between you (“Student,” “Applicant,” “Participant,” “you,” or “your”) and Better Than College LLC (“BTC,” “Company,” “we,” “us,” or “our”), a limited liability company organized under the laws of the Commonwealth of Pennsylvania, and a wholly owned subsidiary of Automation Transformation Corporation, a Delaware S-Corporation. By accessing or using the website at betterthancollege.com (the “Website”), submitting an application, enrolling in the Program, or participating in any Program-related activities, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
1. Nature of the Program
1.1 Program Description
Better Than College (the “Program”) is an entrepreneurial certification program designed to provide participants with practical, real-world business experience delivered by practitioners who have built successful careers and startups. The Program is structured around cohorts of approximately fifteen (15) students with a maximum total enrollment of three hundred (300) students. The Program takes place in person in Philadelphia, Pennsylvania.
1.2 Non-Accredited Status - Critical Disclosure
The Program is not an accredited college, university, trade school, vocational school, or post-secondary educational institution of any kind. The Program is not accredited by any state, federal, regional, national, or international accrediting body, including but not limited to the Middle States Commission on Higher Education or any agency recognized by the U.S. Department of Education.
The certification awarded upon completion of the Program does not constitute a degree, diploma, license, or any form of credential recognized by any governmental authority or educational institution. The certification is proprietary to Better Than College LLC and carries no guarantee of transferability, recognition, or acceptance by any employer, educational institution, licensing board, or government entity.
1.3 No Guarantee of Outcomes
Better Than College makes no representations, warranties, or guarantees -express, implied, statutory, or otherwise -regarding the outcome of participation in the Program. Without limitation, BTC does not guarantee that any participant will: (a) successfully start, operate, or sustain a business; (b) achieve any particular income level, revenue, profit, or financial return; (c) obtain employment, a job offer, or career advancement; (d) acquire any particular skill, competency, or qualification; or (e) receive any particular benefit, tangible or intangible.
1.4 Not Professional Advice
Nothing provided during the Program -including coaching, mentorship, workshops, curriculum content, or informal guidance -constitutes legal, financial, tax, accounting, investment, or other professional advice. All information is provided for general educational and informational purposes only. Participants are solely responsible for seeking qualified professional advice for their individual circumstances.
2. Eligibility and Enrollment
2.1 Age and Eligibility Requirements
The Program is open exclusively to individuals who are eighteen (18) years of age or older at the time of enrollment. By submitting an application, the Applicant represents and warrants that they are at least eighteen (18) years of age. BTC reserves the right to require proof of age at any time and to reject or terminate enrollment if the age requirement is not met.
2.2 Application Process
Enrollment in the Program requires submission of a completed application through betterthancollege.com, accompanied by a non-refundable application fee of Fifteen United States Dollars ($15.00) (the “Application Fee”). Submission of an application does not guarantee admission. BTC reserves the sole and absolute right to accept or reject any application for any reason or for no reason.
2.3 Application Fee - Non-Refundable
The Application Fee of $15.00 is strictly non-refundable under all circumstances, including but not limited to: rejection of the application, withdrawal of the application by the Applicant, failure to complete enrollment, cancellation of the Program, changes to the Program schedule or format, Applicant dissatisfaction for any reason, or any other cause whatsoever.
2.4 Program Tuition
Upon acceptance, admitted students will be required to pay the full program tuition of Twelve Thousand United States Dollars ($12,000.00) (the “Program Tuition” or “Program Cost”) and any associated fees as specified in the enrollment agreement provided at the time of admission.
The Program Tuition is strictly non-refundable under all circumstances. Without limitation, no refund, partial refund, pro-rated refund, credit, deferral, or transfer of the Program Tuition or any portion thereof will be issued for any reason.
2.5 Payment Terms
Program Tuition must be paid in full prior to the Program Start Date unless BTC, in its sole discretion, agrees to an alternative payment arrangement in writing. Failure to make any scheduled payment constitutes a material breach of these Terms and may result in immediate dismissal from the Program without refund.
2.6 Chargeback Prohibition
The Participant agrees not to initiate any chargeback, payment dispute, or reversed transaction with any bank, credit card company, payment processor, digital wallet provider, or any other financial institution with respect to any fees paid in connection with the Program.
3. Program Logistics
3.1 Program Commencement
The Program is scheduled to commence on September 21, 2026 (the “Start Date”). BTC reserves the right to modify the Start Date, program schedule, session times, session locations within Philadelphia, curriculum, syllabus, instructors, coaches, mentors, guest speakers, cohort assignments, cohort size, or any other aspect of the Program at any time, for any reason, in its sole discretion, with or without notice.
3.2 In-Person Attendance Requirement
All classes, workshops, coaching sessions, cohort meetings, networking events, and program-related activities will take place in person at designated locations within Philadelphia, Pennsylvania. Attendance is the sole responsibility of the Participant.
3.3 Failure to Attend
Failure to attend sessions, regardless of the reason, does not entitle the Participant to any refund, credit, make-up session, extension, or other accommodation.
4. Assumption of Risk
Participation in the Program is entirely voluntary. By enrolling and participating, the Participant acknowledges, understands, and expressly assumes all risks, known and unknown, foreseeable and unforeseeable, associated with participation in the Program, including but not limited to: travel and transportation risks; premises and physical risks; health and illness risks (including communicable diseases); emotional and psychological risks; financial risks; third-party risks; and technology and data risks.
5. Intellectual Property
5.1 Company Intellectual Property
All curriculum, course materials, proprietary methodologies, frameworks, templates, presentations, workbooks, assessments, recorded content, software tools, trade secrets, and any other materials provided or made available through the Program (“Company Materials”) are the sole and exclusive intellectual property of BTC and/or its licensors.
5.2 Participant Intellectual Property
Participants retain ownership of their original work product and intellectual property created during the Program. However, by participating in the Program, each Participant grants BTC a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, display, distribute, and create derivative works of Participant IP for marketing, promotional, educational, and portfolio purposes.
5.3 Name, Likeness, and Testimonials
Participants grant BTC and its affiliates the irrevocable, perpetual, worldwide, royalty-free right and permission to use their name, likeness, photograph, video recordings, audio recordings, written statements, and biographical information for marketing, promotional, advertising, and educational purposes in any media.
6. Code of Conduct and Dismissal
Participants are expected to conduct themselves in a professional, respectful, and ethical manner at all times. BTC reserves the right to dismiss any Participant from the Program at any time, for any reason or for no reason, in its sole and absolute discretion, without prior notice, warning, hearing, appeal, or opportunity to cure. Dismissal from the Program does not entitle the Participant to any refund of any fees paid.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Participant hereby releases, waives, discharges, and covenants not to sue Better Than College LLC, Automation Transformation Corporation, and their respective members, managers, officers, directors, shareholders, employees, agents, independent contractors, coaches, mentors, instructors, guest speakers, affiliates, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or related to the Program.
In no event shall the total aggregate liability of all Released Parties combined exceed the lesser of: (a) the total amount actually paid by the Participant in Program Tuition; or (b) Twelve Thousand United States Dollars ($12,000.00).
8. Dispute Resolution
8.1 Governing Law
These Terms shall be governed by, construed under, and enforced in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflicts of law principles.
8.2 Mandatory Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Program, or the Participant’s relationship with BTC that is not resolved through good-faith negotiation shall be resolved exclusively through mandatory binding arbitration in Philadelphia, Pennsylvania, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
8.3 Class Action Waiver
The Participant agrees that any and all dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, collective, or representative action.
8.4 Limitation Period
Any Claim arising out of or related to these Terms must be filed within one (1) year after the date the Claim first accrued, regardless of any longer statute of limitations provided by law.
9. Electronic Communications and Consent
By providing your email address, phone number, or other contact information, you expressly consent to receive communications from BTC and its affiliates via email, text message (SMS/MMS), push notifications, phone calls, and any other electronic or digital communication method for purposes related to the Program and marketing.
10. Website Terms
The Website is provided for informational purposes and to facilitate the application and enrollment process. You agree not to: use the Website for any unlawful purpose; attempt to gain unauthorized access to any portion of the Website; or interfere with or disrupt the operation of the Website. The Website may contain links to third-party websites. BTC is not responsible for the content or practices of any third-party websites.
11. General Provisions
BTC reserves the right to modify these Terms at any time. Updated Terms will be posted on betterthancollege.com with a revised “Last Updated” date. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force. These Terms, together with the Privacy Policy, the Liability Release and Waiver, and the Participation Agreement, constitute the entire agreement between the Participant and BTC.
